This Acceptable Use Policy ("AUP") governs your access to and use of the websites, software, AI agents, automations, and professional services (collectively, the "Services") provided by SYNTHFY LLC, a Texas limited liability company ("Synthfy", "we", "us"). By using the Services, you and the organization you represent ("Customer", "you") agree to this AUP. This AUP supplements our Terms of Service.
1. General Responsibilities
You are responsible for all activity conducted through your accounts, agents, and integrations, and for ensuring that your use of the Services complies with all applicable laws, regulations, and third-party terms. You must obtain and maintain all consents, permissions, and lawful bases required for any data, contacts, or content you submit to or process through the Services.
2. Prohibited Activities
You may not use the Services to:
- Violate any law, regulation, or third-party right, or facilitate any illegal activity;
- Send unlawful, deceptive, or unsolicited communications, including any messaging that violates the TCPA, CAN-SPAM Act, telemarketing/Do-Not-Call rules, or equivalent laws;
- Infringe, misappropriate, or violate any intellectual property, privacy, or publicity right;
- Upload or transmit malware, or attempt to gain unauthorized access to any system, network, or data;
- Probe, scan, overload, or circumvent the security or integrity of the Services or any connected system;
- Engage in fraud, impersonation, market manipulation, or misrepresentation;
- Generate or distribute content that is harassing, defamatory, hateful, or that exploits or endangers minors;
- Scrape, harvest, or collect data from third parties in violation of their terms or applicable law.
3. AI Agents & Automation
Where the Services deploy AI voice, chat, email, or workflow agents on your behalf, you agree to: (a) disclose the automated nature of interactions where required by law; (b) maintain meaningful human oversight for decisions that produce legal or similarly significant effects on individuals; (c) not present AI-generated output as professional, legal, medical, or financial advice; and (d) review and validate automated outputs before relying on them. You are responsible for the instructions, prompts, scripts, and knowledge bases you configure.
4. Communications, Voice & SMS
If you use phone-answering, outbound calling, SMS, or email automation, you must obtain valid consent from recipients, honor opt-out and do-not-call requests promptly, provide required call-recording and identification disclosures, and comply with all applicable telecom and anti-spam laws. You are the sender/caller of record for communications you initiate through the Services.
5. Healthcare & Regulated Data
The Services are not HIPAA-certified, and Synthfy does not enter into Business Associate Agreements (BAAs). You must not use the Services to create, receive, maintain, or transmit Protected Health Information (PHI) or other data subject to HIPAA. For healthcare and similar regulated settings, the Services may be used only for front-desk and administrative tasks — such as appointment scheduling, reception, reminders, and general inquiries — and must not be used for clinical, diagnostic, or treatment decisions.
6. Financial & Trading Automation
Any trading, analytics, or financial-automation features are tools only and do not constitute investment, financial, legal, or tax advice. You are solely responsible for your trading decisions, regulatory compliance, and any resulting outcomes or losses. Past performance does not guarantee future results.
7. Third-Party Services & Integrations
The Services may connect to third-party platforms (for example CRMs, calendars, telephony, messaging, and cloud providers). Your use of those platforms is governed by their own terms, and you are responsible for maintaining the rights and credentials necessary to connect them.
8. Enforcement & Suspension
We may investigate suspected violations and may suspend or terminate access, remove content, or disable integrations — with or without notice — to protect the Services, our customers, or third parties, or to comply with law. Repeated or severe violations may result in termination without refund.

10. Changes to This Policy
We may update this AUP from time to time. Material changes take effect when we post the updated version with a new "Last Updated" date. Continued use of the Services constitutes acceptance of the updated AUP.
